Terms of Service
Effective: 13 September 2026. These terms govern access to and use of Fincary.
By accessing or using Fincary, you agree to these Terms and the policies incorporated by reference. If you do not agree, do not use the service. References to "Fincary", "we", "us" and "our" mean the operator of the Fincary platform.
1. The service
Fincary provides software tools intended to automate or assist financial, accounting, data-processing and related workflows. Features, supported formats, tools, limits and availability may change over time. Individual tools may have separate usage units, technical requirements and plan limits.
2. No professional, banking or investment advice
Fincary is a technology platform and its automated outputs are not, by themselves, accounting, audit, tax, legal, investment, banking, credit or other professional advice. Use of Fincary does not create an accountant-client, lawyer-client, advisor-client, fiduciary or similar professional relationship. Professionals who assist, consult or guide development of Fincary do not thereby become engaged by a user. You remain responsible for reviewing outputs and obtaining appropriate professional advice before relying on them for material decisions, filings, books, reports or compliance.
3. Accounts
You must provide accurate authentication information and maintain control of your sign-in account and devices. An account is personal to the authenticated user unless Fincary expressly provides a team or enterprise arrangement. You are responsible for activity conducted through your account and must notify us promptly of suspected unauthorised access.
4. Your data and authority
You retain responsibility for information and files you submit. You represent that you have the lawful authority, permission and rights necessary to upload and process them through Fincary. You must not use Fincary to process unlawfully obtained data or to violate another person's privacy, confidentiality, intellectual-property or other rights.
5. Automated outputs
Financial documents vary significantly in structure and quality. Automated extraction, classification, conversion and calculation may contain errors, omissions or formatting differences. You must review outputs before using them. Fincary does not guarantee that an output will be complete, error-free, suitable for a particular accounting system, accepted by an authority, or compliant with every law or professional standard applicable to your circumstances.
6. Plans, usage and subscriptions
Free and paid plans may include usage allowances measured by pages, transactions, entries or other units. Usage is determined by Fincary's metering systems. Paid subscriptions begin when successfully activated following payment or authorised activation and continue for the stated term. Prices, limits and features shown at purchase form part of the applicable plan. Changes to generally available plans do not retroactively reduce a paid entitlement already purchased for its existing term unless required for security, law or circumstances beyond reasonable control.
Upgrades may require payment of an additional amount before activation. Downgrades are not currently offered during an active paid term. Enterprise arrangements may be subject to additional written terms.
7. Renewals, cancellation and refunds
Renewal, non-renewal and refund rules are governed by the Refunds & Cancellation Policy, which forms part of these Terms. Turning off renewal does not terminate or refund the current paid term.
8. Acceptable use
You must not misuse Fincary, interfere with its operation or security, circumvent usage limits, automate abusive requests, probe or exploit vulnerabilities, reverse engineer protected components except where law expressly permits it, upload malware, use the service for fraud or unlawful activity, impersonate others, or attempt unauthorised access to accounts, systems or data. We may rate-limit, suspend or terminate access reasonably necessary to protect the service or enforce these Terms.
9. Intellectual property
Fincary and its software, branding, interface, documentation and original platform content are protected by applicable intellectual-property laws. Except for the limited right to use the service under these Terms, no ownership rights are transferred to you. You retain rights you lawfully hold in your uploaded information and outputs derived from it, subject to third-party rights and applicable law.
10. Third-party services
Fincary may rely on or integrate with third-party services such as authentication, cloud infrastructure and payment providers. Their services may be governed by separate terms. Fincary is not responsible for a third party's independent acts, outages or policies except to the extent responsibility cannot lawfully be excluded.
11. Availability and changes
We aim to provide a reliable service but do not guarantee uninterrupted or error-free availability. Maintenance, security events, provider outages, technical failures or legal requirements may affect access. We may modify or discontinue features, while taking reasonable account of active paid entitlements and applicable law.
12. Suspension and termination
We may suspend or terminate access for material breach, fraud, abuse, security risk, non-payment, legal requirements or conduct that threatens Fincary or other users. Expiry or non-renewal of a paid plan may return the account to the then-available free entitlement, subject to its usage rules.
13. Disclaimers
To the maximum extent permitted by applicable law, Fincary is provided on an "as available" basis without warranties not expressly stated in these Terms. Nothing in these Terms excludes warranties, guarantees or consumer rights that cannot legally be excluded.
14. Limitation of liability
To the maximum extent permitted by law, Fincary will not be liable for indirect, incidental, special, consequential, exemplary or punitive losses, or for loss of profits, business, goodwill or data, arising from use of or inability to use the service. Where liability cannot be excluded, any limitation will operate only to the extent permitted by applicable law. Nothing here limits liability that applicable law prohibits us from limiting.
15. Indemnity
To the extent permitted by law, you agree to be responsible for claims and losses arising from your unlawful use of Fincary, your violation of these Terms, or your infringement of another person's rights. This provision does not apply to the extent a claim results from Fincary's own conduct for which liability cannot lawfully be excluded.
16. Governing law and mandatory rights
These Terms are governed by the laws of India, subject to any mandatory consumer, privacy or other protections that apply to you and cannot lawfully be displaced by contract. Courts of competent jurisdiction in India will have jurisdiction, without preventing a user from exercising mandatory rights available in another competent forum under applicable law.
17. Changes to Terms
We may update these Terms as Fincary evolves. The current version and effective date will be posted here. Material changes will be communicated where required by law. Continued use after an effective update constitutes acceptance where legally permitted.
